How do I change names after marriage in Pennsylvania?

First you need proof of your marriage. In Pennsylvania this is commonly called a certified copy of your marriage license or marriage record. Use your marriage record to take any of the name change options listed at the bottom of this guide. Next, update your name with Social Security, then a few days later apply for a name change on your driver’s license and, if applicable, your vehicle title. Finally, notify all other companies.

Apply for your Pennsylvania Marriage License

Marriage licenses are managed by the Clerk of Orphans Court and the Register of Wills. License fees vary between counties, but expect to pay between $40 and $80. Both applicants must attend in person and show government issued photo ID and proof of social security number. Once issued your license is valid in three days, and for up to 60 days.

There are no residency requirements to apply for a marriage license. Licenses issued in Pennsylvania are valid throughout the state. Once your marriage ceremony is held, the officiant will complete the license and return to the Orphans Court for filing. The couple can then order a certified copy of the license from the court to begin changing names.

Marriage records are not automatically issued after your ceremony. Apply to the courthouse in the county where your marriage license was issued, as records are not held at a state level. Fees, process and turnaround varies by county. Google ‘county courthouse marriage record’, plus the name of your county to learn the correct procedure. Many counties offer same day service in person and may also provide for online or mailed applications. 

Prioritize your name change with the SSA

Ensure you first change names with Social Security. Complete form SS5 ‘Application for a Social Security Card’ and file either in person at a Social Security office or return by mail. There is no fee for name change. Your name is generally updated within 2 days of your application being received. Most government agencies only allow you to change to the name as currently listed with the SSA, so be sure to file your SSA name change ahead of your driver’s license.

Pennsylvania DMV license name change

Ensure your name is first changed with the SSA. Next, complete form DL-901, available from the Pennsylvania DMV website, then return by mail. You do not need to include any proof of name change providing you are taking your spouse’s surname. No fee is payable. Pennsylvania vehicle title name change

Ensure your name is first changed with the SSA. Next, complete form MV-41A, available from the Pennsylvania DMV website or included as part of your kit. The form has 2 sides, and only one should be completed depending on your request. If you do not need a replacement title no fee will be charged - complete and return side A. Should you want a replacement title issued in your new name there is a $50 fee – complete and return side B. You can file the form by mail or in person at any DMV office.

If your current passport was issued more than 12 months ago then full renewal fees are payable and no credit is provided for unused time in your passport. What married name can I take in Pennsylvania?

If you’re married in Pennsylvania, you may take any of the following names by simply showing your marriage certificate;

  • Take your spouse’s surname
  • Take your spouse’s surname on all ID and records, but keep using your maiden name at work
  • Add your spouse’s surname to your own (with or without a hyphen)
  • Leave your name as it currently is
Same sex marriages have been recognised in Pennsylvania since May 2014.
For a groom to change surnames they would need to petition the court for a legal name change.
